These Terms of Service (“Terms”) apply to your use of wedoitpools.com (the “Website”), including its service pages, project gallery, contact and estimate forms, click-to-call links, and embedded or linked content. The Website is operated by We Do It Pools LLC (“We Do It Pools,” “Company,” “we,” “us,” or “our”), an Arizona pool contractor that is licensed, bonded, and insured. Our Arizona Registrar of Contractors license number is B-05 225601.
By accessing or using the Website, submitting a form, or contacting us through the Website, you agree to these Terms. If you do not agree, do not use the Website.
You must be at least 18 years old to use the Website or submit a request for services. If you act for a household, property owner, company, or other person, you represent that you are authorized to do so and to provide any information you submit on their behalf.
We provide custom pool construction, pool remodeling, pool renovation, pool resurfacing, pool plastering and replastering, and pool repair services to customers in Tempe, Phoenix, and the East Valley, including Phoenix, Tempe, Mesa, Chandler, Gilbert, Scottsdale, Apache Junction, Queen Creek, Paradise Valley, and San Tan Valley.
The Website provides general information about our Company and services and a way to contact us or request an estimate. Website content, photographs, descriptions, examples, and other materials are informational only. They do not constitute a quote, estimate, offer, construction contract, warranty, or professional advice for a particular property or project.
Website information may not reflect current pricing, availability, materials, project conditions, or service offerings. We may change or remove Website content at any time.
You may request a free estimate through the Website or by calling us. An estimate request is an inquiry, not an order or agreement to perform work. Any estimate or preliminary pricing we provide is non-binding unless expressly stated otherwise in a separate written agreement signed by the parties.
Estimates and project recommendations may depend on an on-site inspection and information about the pool, property, access, grading, soil, utilities, existing structures, permits, project scope, and other conditions. Estimates may need to be revised if conditions or project requirements differ from what was known when the estimate was prepared. Material availability, supplier pricing, taxes, and other costs may also change before a project contract is signed.
No project is approved or scheduled until We Do It Pools and the customer enter into a separate written project contract signed by the parties. That contract governs the project, including scope of work, specifications, price, deposits, progress payments, change orders, cancellation, warranties, and other project-specific terms. If these Terms conflict with a signed project contract, the project contract governs the project to the extent of the conflict.
Pricing, deposits, payment milestones, financing arrangements, late-payment charges, and other payment terms are governed by the applicable signed project contract and applicable law. Do not rely on a Website description or preliminary estimate as the final project price or payment schedule.
Any change to the project scope, materials, specifications, or schedule must be handled in accordance with the signed project contract and applicable law. Additional work or costs may require a written change order or other written approval.
To the extent permitted by the project contract and law, late or non-payment may result in suspension of work or other remedies available under the contract or applicable law. Nothing in these Terms authorizes a remedy prohibited by law or limits any notice or other procedure required before a remedy may be exercised.
Project schedules and completion dates are estimates unless the signed project contract expressly provides otherwise. Weather, permitting, inspections, material availability, subcontractor schedules, site conditions, access, unforeseen conditions, and other factors may affect the schedule.
Responsibility for obtaining permits, approvals, inspections, or other project authorizations will be addressed in the signed project contract. We will perform work within the scope of our license and in accordance with applicable requirements governing the contracted work. Customers must provide reasonable cooperation and information needed for permitting and inspections.
Nothing in these Terms waives a right or remedy available under Arizona law or limits the Arizona Registrar of Contractors’ authority or complaint processes.
You agree to:
Specific obligations may be further described in the signed project contract. If you do not meet an obligation, the project schedule, scope, or cost may be affected as provided in that contract and applicable law.
Any workmanship warranty offered by We Do It Pools is limited to the warranty, if any, expressly stated in the signed project contract. No additional workmanship warranty is created by Website content, a preliminary estimate, or these Terms.
Products, equipment, finishes, and materials may be covered by warranties provided by their manufacturers. Manufacturer warranties are subject to the manufacturer’s terms, conditions, and exclusions. We do not extend or replace a manufacturer’s warranty unless a signed project contract expressly says otherwise.
Nothing in this section limits any warranty or other right that cannot lawfully be disclaimed or limited.
Cancellation, termination, refunds, and changes to a project are governed by the signed project contract and applicable law. Arizona law may provide cancellation or right-to-cancel protections in certain circumstances. Nothing in these Terms waives or restricts a cancellation right that applies to you by law. Any required cancellation notice, form, or procedure will be governed by the applicable law and the documents provided for the transaction.
The Website and its content—including text, design, graphics, logos, service descriptions, project photographs, and other materials—are owned by or licensed to We Do It Pools and are protected by intellectual property laws. “We Do It Pools” and related names, logos, and marks may not be used without our prior written permission.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Website for personal, non-commercial purposes. You may not, without our prior written permission:
You are responsible for information, messages, photographs, reviews, or other materials you submit through the Website or provide to us (“Submissions”). You represent that you have the rights and authority necessary to provide your Submissions and that they do not violate another person’s rights or applicable law.
We may use Submissions to respond to an inquiry, evaluate or perform a project, provide customer service, or maintain business records. We will not treat a photo or other material you provide for an estimate or project as permission to publish it for marketing merely because you sent it to us.
If you separately provide content or project photos for publication or marketing, you grant us a non-exclusive, royalty-free license to use that content for the purpose for which you provided it, where permitted by law. We will not knowingly publish your name, address, or other identifying details with project content without your permission, except as permitted by law. You may opt out of or withdraw permission for future marketing use by contacting info@wedoitpools.com. Withdrawal does not require us to recall materials already distributed or remove content where we have another lawful basis to retain or use it.
You may not use the Website to:
We may restrict or suspend access if we reasonably believe your use violates these Terms or threatens the Website, our business, or another person.
When you submit the estimate form, you agree that we may contact you about your pool project using the contact information you provide, including by telephone, email, or text message, as appropriate to your inquiry. Message frequency varies depending on your inquiry and project. Message and data rates may apply.
Where law requires additional consent for automated calls or texts, prerecorded or artificial-voice calls, or marketing messages, we will obtain that consent separately. Consent to receive automated or marketing calls or texts is not a condition of purchasing goods or services.
You may opt out of marketing text messages at any time by replying STOP. For help, reply HELP or contact us using the information in Section 20. Opting out of marketing messages does not prevent us from sending non-marketing communications reasonably needed to respond to your inquiry, provide services, or meet legal obligations.
The Website may link to third-party websites or include third-party features, such as Google reviews and an accessibility widget. We do not control third-party websites, content, services, or privacy practices and are not responsible for them. Your use of third-party services is subject to the third party’s terms and policies.
We use Google Search Console to monitor Website indexing and search performance. Search Console is a third-party service used by us; it is not a service offered to Website visitors. We do not control Google’s services or policies.
The Website’s accessibility widget is provided by a third party. The widget is intended to offer accessibility-related features, but we do not guarantee that it will meet every user’s needs or resolve every accessibility issue. You may contact us directly for assistance as described in Section 19.
The Website is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, We Do It Pools disclaims warranties regarding the Website, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted, error-free, secure, or continuously available Website access, or that Website content will always be complete, accurate, or current.
This disclaimer applies to the Website and its informational content only. It does not modify a signed project contract or disclaim a warranty or right that cannot lawfully be disclaimed.
To the maximum extent permitted by law, We Do It Pools will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Website or services, including loss of profits, revenue, data, or use, even if advised of the possibility of such damages.
To the maximum extent permitted by law, for claims relating to contracted services, We Do It Pools’ total liability will not exceed the amounts paid by you to We Do It Pools for the specific services giving rise to the claim. Any limitation of liability for a project remains subject to the signed project contract and applicable law.
Nothing in these Terms excludes or limits liability where doing so is prohibited by law, including liability that cannot legally be waived or limited, or limits rights or remedies available under Arizona law or through the Arizona Registrar of Contractors.
To the maximum extent permitted by law, you agree to indemnify and hold harmless We Do It Pools and its personnel from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Website, your violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own acts or omissions or where such indemnification is prohibited by law.
If you have a concern regarding the Website or a project, please contact us first so we can try to resolve it informally. We will make a reasonable effort to review and respond. Informal discussions do not waive any legal rights, deadlines, or remedies.
These Terms do not require arbitration and do not include a class-action waiver. Any arbitration agreement or class-action waiver would need to be separately considered by legal counsel and comply with applicable law.
The Arizona Registrar of Contractors accepts and processes contractor complaints under applicable law. Information about filing a complaint is available at roc.az.gov/file-complaint. Nothing in these Terms limits your right to contact the Registrar, file a complaint, or pursue any other right or remedy available under Arizona law.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Subject to any mandatory legal venue or process, disputes relating to these Terms or the Website shall be brought in the state or federal courts located in Maricopa County, Arizona. Nothing in this section limits any venue, complaint process, or remedy that applicable law requires or permits.
We aim to make the Website accessible and welcome feedback about accessibility barriers. If you need assistance accessing Website information or would like to request an accessible format, please contact us using the details in Section 20. The third-party accessibility widget is described in Section 13; contacting us directly remains an option.
